3. Applicability
These Terms and Conditions apply to every offer, order, and distance contract between the Seller and the Consumer.
Before a distance contract is concluded, the Consumer will have access to these Terms and Conditions. If that is not possible, the Seller will inform the Consumer where these Terms can be reviewed and that they will be sent electronically or otherwise, free of charge, upon request.
If the distance contract is concluded electronically, these Terms and Conditions can also be provided electronically in a way that allows them to be stored on a durable medium.
If, in addition to these Terms and Conditions, specific product or service conditions apply, the Consumer may rely on the provision that is most favorable to them in case of contradiction.
If any provision in these Terms and Conditions is found invalid or unenforceable, the remaining provisions will remain in effect. Any such provision will be replaced with a new one reflecting the original intent as closely as possible.
Situations not covered by these Terms and Conditions will be interpreted “in the spirit” of these Terms and Conditions.
4. Offers
If an offer is valid for a limited period or subject to conditions, this will be stated clearly.
All offers are non-binding and subject to change.
The offer includes a complete and accurate description of the products or services provided. Images are for illustrative purposes and represent the product truthfully, although exact color matching cannot be guaranteed. Obvious errors or mistakes do not bind the Seller.
Each offer clearly describes the rights and obligations associated with acceptance, including:
-
the total price (excluding import VAT and customs fees, which are the Consumer’s responsibility);
-
shipping costs;
-
the process for concluding the contract;
-
applicable payment and delivery methods;
-
whether the right of withdrawal applies;
-
the validity period of the offer or price guarantee;
-
available languages for contract completion;
-
whether the contract will be archived and how it may be accessed by the Consumer.
5. The Contract
The contract is concluded when the Consumer accepts the offer and complies with all stated requirements.
If the Consumer accepts the offer electronically, the Seller will promptly confirm receipt of acceptance electronically. Until confirmation is received, the Consumer may cancel the contract.
If the contract is concluded electronically, the Seller ensures secure data transfer and a safe web environment. If online payment is possible, appropriate security measures will be used.
The Seller may, within legal limits, check whether the Consumer can meet payment obligations and may refuse an order or impose additional conditions if justified.
The Seller will provide the following details along with the order:
-
the Seller’s contact address for complaints;
-
instructions regarding the right of withdrawal;
-
warranty and after-sales information;
-
and, where applicable, termination procedures for ongoing contracts.
6. Right of Withdrawal
Consumers may cancel their purchase within 30 days of receiving the product without providing any reason.
During this period, the Consumer must handle the product and packaging carefully and only use it to the extent necessary to determine if they wish to keep it.
To exercise the right of withdrawal, the Consumer must notify the Seller within 30 days by written or electronic communication. After notification, the Consumer must return the product within 30 days. Proof of timely return (such as shipping confirmation) is required. Returns may be sent directly to the Seller’s supplier if indicated.
If the Consumer does not notify or return the product within the required time, the sale becomes final.
7. Return Costs
Return shipping costs are entirely the responsibility of the Consumer. This includes returns sent to the country of origin (for example, to our supplier in China).
Refunds will be issued as soon as possible, and no later than 30 days after withdrawal, provided the returned item has been received or proof of shipment has been supplied.
8. Exclusions from the Right of Withdrawal
The Seller may exclude the right of withdrawal for the following types of products or services, if clearly stated before purchase:
-
goods made to the Consumer’s specifications;
-
items of a personal nature;
-
goods that cannot be returned due to their nature;
-
perishable goods;
-
sealed goods that cannot be returned for hygiene reasons once unsealed;
-
newspapers, magazines, or downloadable digital goods;
-
audio or video recordings or software once opened by the Consumer.
For services:
-
accommodation, transport, catering, or leisure activities on specific dates;
-
services started with the Consumer’s consent before the end of the cooling-off period.
9. Prices
All prices include applicable taxes unless otherwise stated. Import duties and customs fees are the responsibility of the Consumer.
Prices are subject to change based on legal requirements or VAT rate adjustments.
Obvious typographical or input errors are not binding. The Seller is not obligated to fulfill an order at an incorrect price resulting from such an error.
10. Conformity and Warranty
The Seller guarantees that products and services comply with the agreement, product specifications, and applicable legal standards at the time of delivery.
Defective or incorrectly delivered items must be reported within 30 days of receipt. Items must be returned in original packaging and unused condition.
The warranty does not apply if the Consumer has repaired, altered, or misused the item or failed to follow care instructions.
11. Delivery
The Seller will handle orders with care. Delivery will be made to the address provided by the Consumer.
The Seller will execute accepted orders promptly, usually within a reasonable timeframe, unless a longer delivery time has been agreed. If a product cannot be delivered or is delayed, the Consumer will be notified as soon as possible and may cancel the order for a refund.
Risk of loss or damage transfers to the Consumer once the product is delivered.
12. Ongoing Agreements
Consumers may cancel ongoing agreements at any time with one month’s notice. Fixed-term agreements can be canceled at the end of their duration with one month’s notice.
Contracts lasting longer than one year may be terminated by the Consumer after one year, with a maximum one-month notice period.
13. Payment
Unless otherwise agreed, payment must be made within seven days of the start of the cooling-off period.
The Consumer must report incorrect payment details immediately.
In case of non-payment, the Seller may charge reasonable collection costs within legal limits.
14. Complaints Procedure
Complaints about the execution of the contract must be submitted within seven days after the Consumer identifies a problem.
The Seller will respond within 30 days. If more time is required, the Consumer will be notified of the delay and given an estimated response date.
If a complaint cannot be resolved amicably, it becomes a dispute governed by Article 15.
A justified complaint may result in replacement or repair of the item at no cost to the Consumer.
15. Disputes and Applicable Law
Contracts between the Seller and the Consumer are governed exclusively by Dutch law, even if the Consumer resides in another country.
Disputes shall be submitted to the competent court in the Netherlands unless mandatory consumer law in the Consumer’s jurisdiction provides otherwise.
